Privacy Policy
What we collect when you contact us or browse this site, why we hold it, how long we keep it, and what you can ask us to do with it. Written to be read, not to be skimmed past.
01Who we are
This website is operated by Adam Billig Property Ltd, trading as AB Property UK, a company registered in England and Wales (company number [COMPANY NUMBER]), whose registered office is at 210 - 222 Hagley Road West, Birmingham, B68 0NP.
For the purposes of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, Adam Billig Property Ltd is the data controller for the personal data described in this policy. That means we decide what is collected and why, and we are accountable for it.
We are registered with the Information Commissioner's Office under registration number [ICO NUMBER].
If you have a question about anything in this policy, email info@abpropertyuk.com or call 0121 222 5150.
02What we collect
Information you give us
When you complete the enquiry form on this site, or contact us by email, telephone or WhatsApp, we collect what you choose to tell us. Through the form, that is:
- Full name
- Required. So we know who we are talking to.
- Phone or WhatsApp number
- Required. Most enquiries here are followed up by phone.
- Email address
- Optional. Used to reply in writing and to send you property details.
- Company name
- Optional. Helps us understand the covenant and the requirement.
- Service and message
- Optional. Your requirement - location, size, use class, timing, or the problem you want solved.
If we go on to act for you, we will collect more than this in the course of the instruction - correspondence, identification documents for anti-money-laundering checks, and details of the transaction. That wider processing sits outside this website policy and is covered by our engagement terms.
Information collected automatically
When you visit this site, limited technical information is collected by our hosting provider and by our analytics tool. This includes your approximate location (usually city level), device and browser type, the pages you viewed, and how you arrived at the site. See Cookies and analytics below.
We do not collect special category data through this website - nothing about health, ethnicity, religion, politics, sex life or biometrics - and we ask that you do not send us any.
03Why we use it, and our lawful basis
Under UK GDPR we must have a lawful basis for every use of your personal data. Ours are set out below.
- Answering your enquiry
- To reply, discuss your requirement and prepare a shortlist. Basis: steps taken at your request prior to entering a contract, and our legitimate interest in responding to people who approach us.
- Providing our services
- To act for you on an acquisition, disposal, letting or consultancy instruction. Basis: performance of a contract with you.
- Keeping business records
- To maintain records of who we have acted for and what was agreed. Basis: legal obligation, and our legitimate interest in running the business properly.
- Anti-fraud and site security
- To stop automated form abuse and protect the site. Basis: legitimate interest in security.
- Understanding site usage
- To see which pages are useful and improve them. Basis: your consent, given through the cookie banner.
We do not send marketing emails or newsletters. If you give us your details through this site, we will use them to deal with your enquiry and to act for you - not to add you to a mailing list. If that ever changes, we will ask you first.
06How long we keep it
We keep personal data only as long as there is a reason to, then delete it.
- Enquiries that do not become instructions - two years from your last contact with us, because property requirements often resurface and it saves you repeating the brief. Then deleted.
- Client and transaction records - six years from the end of the instruction, to match the limitation period for contractual claims and our tax record-keeping obligations.
- Anti-money-laundering records - five years from the end of the business relationship, as the regulations require.
- Analytics data - retained by Google for 14 months, after which it is deleted automatically.
You can ask us to delete your enquiry sooner. See Your rights.
07How we protect it
This site is served over HTTPS, so what you type into the enquiry form is encrypted in transit. Our email and file storage are access-controlled and protected by strong authentication. Access to enquiry data is limited to the people in the business who need it to do their job.
No system is perfectly secure, and we would rather say so than claim otherwise. If a breach ever occurred that was likely to risk your rights and freedoms, we would report it to the ICO within 72 hours and tell you directly where the law requires it.
08Your rights
Under UK GDPR you have the following rights over your personal data. They are free to exercise, and we will respond within one month.
- Access - ask for a copy of the personal data we hold about you.
- Rectification - have inaccurate data corrected or incomplete data completed.
- Erasure - ask us to delete your data, where we have no overriding reason to keep it.
- Restriction - ask us to pause our use of your data while a dispute about it is resolved.
- Objection - object to processing we carry out on the basis of legitimate interests.
- Portability - receive data you gave us in a machine-readable format, or have it sent to another controller.
- Withdraw consent - where we rely on consent, such as analytics cookies, you can withdraw it at any time. It does not affect what was done before you withdrew.
To exercise any of these, email info@abpropertyuk.com with what you want and enough detail for us to find your records. We may ask you to confirm your identity first, so that we do not disclose your data to somebody else.
If you are unhappy with how we have handled your data, tell us first and we will try to put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113. Complaining to us does not affect that right.
09International transfers
Some of the services we rely on are operated by companies based outside the UK, principally in the United States. Where personal data is transferred outside the UK, we rely on the safeguards UK law recognises - a UK adequacy decision, or the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses, together with additional technical measures where appropriate.
You can ask us for more detail about the safeguards that apply to a particular transfer.
10Changes to this policy
We will update this policy when what we do with personal data changes, or when the law does. The date at the top of the page always shows when it was last revised. If a change materially affects you, we will do more than quietly amend the page - we will tell you.
This policy covers this website only. Where we link out to another site, that site's own privacy policy governs what it does with your data, and we are not responsible for it.
